Felony charges filed against southeast Michigan mortgage rescue fraud schemes

Felony charges have been brought against four Southeast Michigan individuals and three companies for operating fraudulent mortgage rescue or loan modification schemes, according to Michigan Attorney General Bill Schuette.

Schuette also announced the conviction of a New Haven mortgage rescue modification company on charges of violating the Credit Services Protection Act.

Many are accused of scamming victims into paying large upfront fees, doing nothing to help them avoid foreclosure, ultimately resulting in victims losing their homes.

Several companies and individuals charged are accused of obtaining money through false statements to consumers, a felony punishable by up to five years in prison and/or a $10,000 fine.

 In addition, several are accused of charging upfront fees before services were rendered, a violation of the Credit Services Protection Act. 

Each of the charges carries a penalty of up to 90 days in jail and/or a fine of $1,000 in addition to the requirement that the companies make full restitution to each of their victims.

Those charged include Kyle Gosik, 31, of Ortonville, and David Dziuban, 34, of Plymouth, and Capital Wealth Management in Canton; Rolondo Sage Campbell aka Anthony Carter, 43, of Detroit; E3A in
Detroit; Yvette Woodruff aka Yvette DeBerry, 50, of Southfield; Woodberry Modification Solutions in Southfield; and Impact Homeowners in New Haven.

The charges come as the result of Attorney General investigation targeting scam operations that prey on delinquent homeowners or those facing foreclosure and a joint federal-state nationwide sweep performed by the Consumer Financial Protection Bureau and the Federal Trade Commission.
 

Kovsky-Apap named Top Young Lawyer by DBusiness Magazine

Deborah Kovsky-Apap was named one of Detroit’s Top Young Lawyers by DBusiness magazine. For the second year in a row, DBusiness magazine has asked its readers and more than 18,000 lawyers in the Detroit metro area to nominate accomplished attorneys to be featured in the magazine’s Top Young Lawyers list. Six young lawyers under 40, including Deborah Kovsky-Apap, have been honored with the title. 

Kovsky focuses her practice on insolvency and out-of-court workouts. She also has substantial litigation and trial experience in the areas of bankruptcy, commercial, and securities law. Notably, Kovsky currently represents the City of Detroit in its Chapter 9 bankruptcy proceedings, the largest municipal bankruptcy filing in U.S. history by debt.

“I get a lot of satisfaction knowing that I’ve done the very best I can for my clients and having the recognition from the community and my peers is very gratifying,” Kovsky said.

Kovsky is a graduate of Harvard College (A.B., magna cum laude, 1996) and Columbia Law School (J.D. 2003), where she was a Harlan Fiske Stone Scholar and an associate editor of the Columbia Law Review.
