Family Medical Leave Act benefits discussed

Bodman PLC’s Workplace Law Group attorneys recently began a new series of quarterly “Sunrise Roundtable” sessions at the firm’s Troy offices. The event focused on the Department of Labor’s final rule, issued on February 25, 2015, that defines “spouse” under the Family Medical Leave Act (FMLA) to include same sex spouses.  As a result of the rule, employers must extend FMLA benefits to same sex spouses if the same sex marriage was legal in the state where it took place. This means Michigan employers must grant FMLA benefits to same sex couples legally married elsewhere even though Michigan does not recognize same sex marriage. Bodman attorneys (left to right) Karen Piper, Maureen Rouse-Ayoub and Charles Russman provided the information employers need to comply with FMLA and answered questions regarding when and how retirement, welfare and other benefits must be provided to same sex spouses. “In Workplace Law, the law changes quickly,” said Rouse-Ayoub, who is Workplace Law Group chair. “This is an opportunity for our clients and friends to learn about the developments that they need to know to do business in a quick fashion and an opportunity to discuss the issues in an hour so they walk away with a good understanding of what they need to know.”
