High court takes Miranda case from Jackson County

JACKSON, Mich. (AP) -- The Michigan Supreme Court has agreed to look at the case of a man who incriminated himself in a Jackson County homicide after saying he didn't want to answer questions. The appeals court says Kadeem White's statements could be used against him because the detective didn't actually ask a question. The officer instead said he hoped a gun used in a homicide wouldn't be found and used by someone else. Then he added, "OK?" White eventually said, "I didn't mean to do it." He never waived his Miranda rights against self-incrimination. The Supreme Court agreed last Friday to take an appeal from White. Appeals court Judge Douglas Shapiro says White's statements should be suppressed or else it's a "mockery" of the right to remain silent. Published: Tue, Apr 3, 2012
