Hathaway asks to be released from prison
ANN ARBOR (AP) — Former Michigan Supreme Court Justice Diane Hathaway is pleading with a judge to reduce her prison sentence for fraud or at least put her on home detention for six months.
Hathaway’s request was filed electronically last Friday with the Ann Arbor federal judge who sent her to prison for 366 days. She has spent five months at a West Virginia federal prison.
Hathaway pleaded guilty to bank fraud for shifting properties and failing to disclose assets while trying to dump her Detroit-area home in a short sale. She quit the Supreme Court a few days after the charge was filed.
Hathaway says she’s earned 14 certificates and has maintained good conduct. The certificates include achievement in “sweating to the oldies” and “brisk walking.”
Prosecutors declined to comment.
Man released from prison sues lawyer
ROYAL OAK, Mich. (AP) — An Oakland County man is taking his former attorney to court after serving more than six years in prison for a sexual assault conviction that was thrown out by the Michigan Supreme Court.
Jackob Trakhtenberg was convicted in 2006 after a 53-minute trial. Defense attorney Deborah McKelvey didn’t ask for a jury and didn’t make an opening statement. Her only witness was Trakhtenberg, who denied the allegations involving a child.
In 2012, the state Supreme Court said McKelvey’s performance was inadequate and violated her client’s rights.
McKelvey’s attorney, Michael Sullivan, tells the Detroit Free Press that her trial strategy was sound. Trakhtenberg’s civil lawsuit seeks more than $50,000.
The state appeals court in December said the retired engineer’s case can go forward in Oakland County.
