Medical marijuana law trumps law on transporting pot
ST. JOHNS, Mich. (AP) — The Michigan appeals court says the state’s medical marijuana law protects people who are accused of illegally transporting pot.
In a 2-1 decision, the court threw out the misdemeanor conviction of a man in Clinton County, north of Lansing.
Callen Latz is a registered medical marijuana user. But he was charged in 2014 with violating a law that requires pot to be stored in a case in the trunk of a vehicle or in a spot that’s not easily accessible.
The marijuana transportation law was signed in 2012, four years after voters approved medical marijuana for certain illnesses. The appeals court says the transportation law doesn’t fit because it puts additional requirements on compliant medical marijuana users.
The court says that conflict can’t stand. The decision was released Wednesday.
No charges in 2 fatal shootings by police
DETROIT (AP) — No charges will be filed in the separate fatal shootings of two people by suburban Detroit police.
The Wayne County prosecutor issued lengthy statements Wednesday in the deaths of Kevin Matthews a year ago and Janet Wilson last January. Both were killed by Dearborn police, although Matthews was shot in Detroit after a chase on foot and an intense physical struggle.
Prosecutor Kym Worthy says both shootings are cases of police self-defense. She says the decisions are “heart-wrenching for all parties involved.”
Worthy says Matthews was killed by a Dearborn officer after breaking free and trying to get control of the officer’s gun.
Wilson was shot in her car. The prosecutor says she tried to run down a Dearborn officer after a dispute at Fairlane Mall.
Holiday Hours
The 36th District Court will be closed for the holidays Friday, Dec. 23 through Tuesday, Dec. 27 and Friday, Dec. 30 through Monday, Jan. 2, 2017. All probable cause conferences and preliminary examinations for felony cases will be held at 8:30 a.m. at the Frank Murphy Hall of Justice on the 2nd floor Dec. 27-29. Felony arraignments will be held at noon at the 36th District Court Dec. 27-29.
All other in-custody misdemeanors will be held at 10 a.m. Dec. 28-29.
The Third Circuit Court Civil, Criminal and Family Divisions will be closed Friday, Dec. 23 through Friday, Dec. 30.
During the three days between Christmas and the New Year’s Eve holiday, the Criminal Division will be staffed to handle arraignments and bench warrants. The Civil Division will be staffed to handle emergency matters. The Family Division will be staffed to process emergency juvenile intake matters, emergency domestic relations and personal protection matters. The County Clerk’s Office will be staffed to accept civil and domestic relations pleadings and new case filings.
The Michigan Supreme Court will be closed Friday, Dec. 23; Monday, Dec. 26; and Friday, Dec. 30.
