Judge dismisses murder charge against nine-year-old boy

CENTREVILLE (AP) — A judge has dismissed a murder charge against a nine-year-old boy accused of fatally shooting his mother in their southern Michigan home.
St. Joseph County Family Division Judge David Tomlinson made the ruling last Friday. Under state law, the boy was presumed incompetent for trial because he’s not yet 10.

WOOD-TV reports the third-grader hugged his father and cried after the ruling.

The boy was accused of the May 6 shooting at the family’s home near Sturgis.

Tomlinson criticized a state law that bars him from ordering help for the boy. St. Joseph County Chief Assistant Prosecutor Josh Robare told the judge he fears the boy could kill again without treatment.

The AP is not identifying the victim because to do so would identify the boy.


City argues man can’t sue over gun restrictions

COLUMBUS, Ohio (AP) — The city of Columbus is asking the Ohio Supreme Court to rule individuals have no right to sue the city to overturn gun restrictions.

City Attorney Zach Klein argues gun rights activist Gary Witt has no legal grounds to challenge the ordinances because he hasn’t been harmed by them.

The filing says people only have legal grounds to sue if they’ve been charged with a misdemeanor under the ordinances.

The Columbus Dispatch reports the 10th District Court of Appeals last month dismissed Ohioans For Concealed Carry and the Buckeye Firearms Association as plaintiffs in Witt’s lawsuit.

The same appeals court previously overturned a lower court decision that said Columbus’ ban on bump stocks, which allows rifles to fire rapidly, was unconstitutional.


Drum roll: School with no band invites band with no football

MAPLE CITY (AP) — One northern Michigan school has a football team but no marching band. Another school has a band but no football.

So the schools made a deal — and filled the air with music Friday night.

Maple City Glen Lake invited the marching band from Forest Area to play at its home game. Forest Area, near Traverse City, lost its football season a few weeks ago due to a lack of players.

Forest Area musicians were ecstatic to play. Ashley Peckat, a senior, says she “absolutely flipped.” She says it was important to take the field in Leelanau County and “show people what we can do.”

Glen Lake athletic director Mark Mattson there’s nothing like having a band “rocking out with our fans.” He says the Forest Area band is always welcome.


Oh deer! Woman pumping gas kicked in head by deer

JACKSONVILLE, Fla. (AP) — A Georgia woman went to fill up her gas tank before work when a deer leaped over her head, kicking her in the process.

Lynda Tennent told WJXT-TV she was pumping gas in Brunswick, Georgia, last week when the incident occurred.

Tennent says she thought she was being robbed. The animal’s hoof hit when she wasn’t looking.

She says she stood there for a minute to process what happened. She didn’t say whether she suffered any other injuries.

Despite everything, she told the television station she was still in good spirits.

Tennent says the deer ran off.
