'Probate Process from Start to Finish' explored in series

The National Business Institute will present the two-part online CLE series “Probate Process from Start to Finish” on Tuesday and Wednesday, July 19-20, from 11 a.m. to 2:15 p.m. each day.

Whether attorneys are about to embark on their first probate case or they are seasoned practitioners, or even if they just want to know how it works, this two-part series will break it down into essential tasks and provide the tools to succeed.

Part 1 on July 19 will give step-by-step instruction through the critical first steps of the probate process. From obtaining letters of authority and gathering the necessary documents to creating the inventory, handling creditors, and planning for tax, the attorney faculty will help attendees avoid mistakes and missed deadlines. Attendees will learn how to:

• Start the case off on the right foot by confidently navigating critical first steps.

• Advise personal representatives by examining all powers, duties, responsibilities, and compensation guidelines.

• Gather, value, and maintain all assets - and learn when and how to employ a financial expert.

• Pick up tips for validating, prioritizing, and satisfying creditor claims.

• Get practical guidance for post-mortem planning, trust administration, and tax hurdles.

Part 2 on July 20 will offer specific guidance for wrapping up the estate without mistakes and for resolving beneficiary and fiduciary disputes. The faculty will discuss keeping practices above board with a legal ethics compliance manual tailored to the key tasks and dilemmas of probate.  Attendees will learn how to:

• Discover how to litigate deed contests, lost or contested wills, fiduciary misconduct, and more.

• Put the decedent’s affairs to rest by making distributions, filing the final tax return, and completing the final accounting.

• Explore legal ethics issues commonly faced during probate.
