OFF THE PRESS

The American Law Institute-American Bar Association (ALI-ABA) recently announced that its “409A: The 100 Most Frequently Asked Questions” book is now available. The text tackles the Internal Revenue Code section 409A and provides concise, understandable and accurate answers on how the rules work as well as helpful practice tips.

“Section 409A is one of the most important changes in the tax law governing business compensation techniques in the past 30 years,” said Brian W. Berglund, co-author of “409A: The 100 Most Frequently Asked Questions.” “We found that there was a lack of useful and practical information available on this complex and often confusing new tax law even though the law potentially impacts most types of compensation used today by employers of all types and sizes.”

The book discusses the nuances of nonqualified deferred compensation in a user-friendly format that enables both experts and novices to short-circuit the tedious research often required by 409A. Questions and answers are cross-referenced as appropriate, and the book provides citations that direct readers to more detailed research quickly and precisely. Checklists and forms based upon the requirements of section 409A are also included.

“We decided to begin with those questions we were hearing regularly from business clients of every type in our daily work,” said co-author Louis R. Richey. “The 100 questions contain all the income tax concepts incorporated into section 409A and the citations contain the detail, so a user can find the answer to almost any section 409A question using our book.”
