Organizations will now be able to use income tax check-offs for donations made toward creating a World War II Legacy Memorial in the state under legislation signed last Thursday by Michigan Gov. Rick Snyder.
“By adding these check-offs and creating the World War II Legacy Fund, we are providing the opportunity for organizations to commemorate and cement the legacy of those who fought to protect the lives of many in World War II,” Snyder said.
SBs 816 and 817, sponsored by Sens. Peter MacGregor and Steven Bieda, respectively, create the Michigan World War II Legacy Memorial Fund to recognize individuals who served in World War II by building an official Michigan monument in their honor. The bills are now Public Acts 256 and 257 of 2018.
Snyder also signed 22 additional measures:
• SB 344, sponsored by state Sen. John Proos, allows a school district or public school academy to grant a high school diploma STEM “endorsement” to any student who completes certain credit requirements with science, technology, engineering and math courses. The bill is now PA 241 of 2018.
• SB 343, sponsored by Sen. John Proos, requires the boards of local school districts and public school academies to ensure students are provided with the most recent career outlook for in-demand jobs in the region that the school district, intermediate school district or public school academy is located. The bill is now PA 242 of 2018.
• HB 5379, sponsored by Rep. Kevin Hertel, allows students to have USDA approved, over-the-counter topical substances, such as sunscreen, at schools if the student has written permission from a parent or legal guardian and the approval, if required, is provided to the school’s principal or chief administrator. The bill is now PA 243 of 2018.
• SB 988, Sen. Peter MacGregor, amends the Social Welfare Act to eliminate the sunset on the hold-harmless provision that requires the Michigan Department of Health and Human Services to pay the county share for certain services provided by private foster care providers. The bill is now PA 244 of 2018.
• SB 1015, sponsored by Sen. Dave Hildenbrand, updates the formula for Michigan’s Hospital Rate Adjustment to reflect a new federal formula. The bill is now PA 245 of 2018.
• HB 5805, sponsored by Rep. John Bizon, amends the Public Health code, revising language concerning costs savings to a purchaser of a generically equivalent drug product or an interchangeable biological drug product. The bill is now PA 246 of 2018.
• HB 5086, sponsored by Rep. David Maturen, amends the Local Community Stabilization Authority Act (LCSA) to revise details and formulas for reimbursements to distribute revenue to local governments for the loss related to personal property tax reform. The changes will result in a more stable and transparent system for reimbursement. The bill is PA 247 of 2018.
• HB 5908, sponsored by Rep. Rob VerHeulen, amends the Local Community Stabilization Act (LCSA) to exclude authorities and libraries from the distribution of funds greater than 100 percent of personal property tax losses. It also directs $13.6 million per year to Fire Protection Grants. The bill is now PA 248 of 2018.
• HB 4115, sponsored by Rep. Eric Leutheuser, amends the Sales Tax Act to exempt non-profit organizations such as schools and churches from the first $10,000 in sales tax as long as the organization’s aggregate sales are less than $25,000 in a calendar year. The bill is now PA 249 of 2018.
• HB 5435 and 5436, sponsored by Reps. Eric Leutheuser and Ben Frederick, amend the Commercial Rehabilitation Act (CRA) and Obsolete Property Rehabilitation Act (OPRA) to create a process for a taxpayer to revoke a certificate issued under either act and allow the taxpayer to seek reinstatement of a revoked certificate under certain circumstances. The bills are now PAs 250 and 251 of 2018.
• SBs 197 and 196, sponsored by state Sens. Peter MacGregor and Marty Knollenberg, create the Fostering Futures Scholarship income tax check-off and provide for contributions made from the Fostering Futures Scholarship check-off to be deposited in the Fostering Futures Scholarship Trust Fund. The bills are PAs 252 and 253 of 2018.
• HBs 4030 and 4031, sponsored by Rep. Wendell Byrd, creates an income tax check-off for the Lions of Michigan Foundation and the Lions of Michigan Fund for the purposes of collecting and distributing check-off donations. The bills are now PAs 254 and 255 of 2018.
• HBs 5739 and 5740, sponsored by Reps. Steve Marino and Diana Farrington, respectively, creates an income tax check-off for the Kiwanis Club and the Kiwanis Club Fund for the purposes of collecting and distributing check-off donations. The bills are now PAs 258 and 259 of 2018.
• SB 946, sponsored by Sen. Ken Horn, codifies the Skilled Trades Training Program, makes leadership training a reimbursable expense and extends the training window for up to a year. The bill is now PA 260 of 2018.
• SB 226, sponsored by Sen. Rick Jones, adds GPS and photo verification fees to the list of fees that can be collected by process servers. The bill is now PA 261 of 2018.
• HB 4871, sponsored by Rep. Stephanie Chang, amends the statute that governs business improvement zones (BIZs) to clarify the start/end date for authorization of a BIZ and allows for flexibility of the duration BIZ. The bill is now PA 262 of 2018.
• HB 4609 and 4610, sponsored by Reps. Steve Marino and Diana Farrington, respectively, increase the minimum fund balance of the Disaster and Emergency Contingency Fund (DECF) to $2.5 million and raises the cap on grant amounts to local governments from $250,000 to $1 million, depending on the local unit of government’s population. The bills are now PAs 263 and 264 of 2018.
