Court rejects appeal over lies at 2005 drug trial in Wayne County
DETROIT (AP) — The Michigan Supreme Court won’t intervene in the case of a man who wants his drug conviction erased because of perjury at a 2005 trial in Wayne County.

The court voted 4-2 in an order released Thursday.

There is no dispute that a judge allowed police officers to lie to cover up the role of a paid informant who stood to gain thousands of dollars. The jury in Alexander Aceval’s cocaine trial couldn’t reach a verdict but he subsequently pleaded guilty and is in prison.

After that guilty plea, Aceval’s lawyer learned that perjury was committed at trial. David Moffitt argued that prosecutors should be forever barred from pressing charges because of the misconduct.

Retired Judge Mary Waterstone, a former prosecutor and two officers are awaiting trial on perjury-related charges.

Patricia Nemeth and Terry Bonnette presented “How to Keep Rockin’ when the EEOC’s a Knockin’” to the Health Care Association of Michigan in Mt. Pleasant on Sept. 19.

The firm’s “Raising the Bar,” an educational series about current issues in employment and labor law, addressed the complexities involved in classifying workers at its Sept. 29 seminar, “Independent Contractor or Employee? A Wrong Guess Could Be Costly.” The presenter was Susan Koval.

Nemeth and Linda Burwell presented “Litigating Employment Claims in Michigan: The Effects of Nuanced State Laws and a Rejuvenated EEOC” to a large group of insurance representatives in October in Chicago.

Burwell presented “Employee Privacy in the Electronic Age: Is Big Brother Watching You?” at the acclaimed Bernard Gottfried Labor Law Symposium in October in Detroit.
In October, Burwell and Nemeth addressed social networking issues affecting employers at a large multi-national insurance group in Connecticut in a presentation entitled, “Hey, Get out of my Face…Book!” Terry Bonnette presented on the same topic at the Greater Ann Arbor Society for Human Resource Management (GAASHRM) in November.

Cliff Hammond presented “Hiring and Firing within the Law” at the American Society of Employers (ASE) in Southfield in November.
Burwell facilitated a Continuing Legal Education session entitled “Working with The EEOC – An Insider’s Perspective” at a national meeting of law firms in October in Washington D.C.
