Suit filed in death of former pitcher Mark ‘The Bird’ Fidrych
WORCESTER, Mass. (AP) — The family of former Major League pitcher Mark Fidrych has filed a lawsuit in connection with his accidental death in 2009.
Fidrych was working on his Mack truck at his home in Northborough when his clothing became caught in the vehicle’s power takeoff shaft.
The Telegram and Gazette reports that Fidrych’s widow, Ann Pantazis, recently filed a civil suit in Worcester Superior Court. It names Greensboro, N.C.-based Mack Trucks, along with two Worcester companies, Morse Mack Sales and Ballard Mack Sales & Service.
The lawsuit, which seeks unspecified damages, alleges that the truck was in a “dangerous and defective condition” when sold.
The plaintiffs have denied the allegations in responses filed to the lawsuit.
Fidrych, nicknamed “The Bird,” was the 1976 American League Rookie of the Year and went on to pitch five seasons for the Detroit Tigers.
Federal appeals court reinstates lawsuit over Flagstar stock
TROY, Mich. (AP) — Some current and former employees will get another chance to pursue a lawsuit against Flagstar Bank over company stock in their retirement accounts. A federal appeals court has reinstated the case in Detroit federal court. The Troy-based bank is blamed for offering Flagstar stock to employees at a time when the bank was in perilous shape. Flagstar’s stock price lately has been under a dollar, compared with nearly $15 in 2007. The court says the lawsuit raises a “plausible claim” that Flagstar breached its fiduciary duty to employees during that time.

The bank has said workers made their own investment decisions.

Zelenock named co-chair of the Scholarship Committee for FCBA
Emily J. Zelenock, a partner in Honigman Miller Schwartz and Cohn LLP’s Intellectual Property and Technology Department, was named as co-chair of the Scholarship Committee for the Federal Circuit Bar Association (FCBA).  The committee manages the Bar’s scholarship selection process and announcements, as well as develops and implements ways of obtaining new scholarships.

Zelenock concentrates her practice on patent, copyright and trade secret litigation and related counseling. She also advises clients on licenses, joint venture agreements and intellectual property aspects of mergers and acquisition transactions. In addition to co-chairing the Scholarship Committee, Zelenock serves on the Amicus Committee for the Federal Circuit Bar Association and is a member of the Patent Litigation Committee of the American Intellectual Property Law Association.  She is also a member of the Michigan Intellectual Property Law Association.

Zelenock earned a J.D. from the University of Michigan Law School and a B.S., with distinction, from the University of Michigan.
