Photographer sues over use of Heisman pose shot

DETROIT (AP) -- The photographer who snapped Desmond Howard's Heisman Trophy touchdown pose in a 1991 game is suing the former Wolverine superstar and Sports Illustrated for using it. The Detroit Free Press recently reported that Brian Masck says Howard, the magazine and others unlawfully copied and marketed the shot. He has filed a copyright infringement lawsuit in U.S. District Court in Detroit. Masck didn't obtain a copyright until 2011. Masck took the photo after Howard scored on a 93-yard punt return against Ohio State University. Masck claims he never authorized the photo to be used in magazines and in memorabilia. Masck says he also didn't get credit for the photo or paid. The Associated Press has emailed Howard for comment. The newspaper says Sports Illustrated lawyers declined comment.
