Michigan hospital worker is reinstated in case of spilled spuds

DEARBORN (AP) - A man who was fired for putting dirty potatoes on a food prep table can regain his job at a Detroit-area hospital.

A federal appeals court sided with an arbitrator who had reinstated Shannon "Ken" Curry to the kitchen at Oakwood Hospital.

While cleaning up spilled potatoes in 2012, Curry was accused of sweeping them with other debris and placing all of it on a food prep table.

The arbitrator agreed that Curry had violated a major rule, but he noted his many years of service and said a dismissal was too harsh. He ordered anger management training and no back pay.

The hospital called it unusual "industrial justice." But the appeals court said Monday that the arbitrator didn't exceed his authority. The court ruled in favor of Curry's union.
