Man who acted as own lawyer decade ago could be freed

DETROIT (AP) - A 28-year-old Flint man who acted as his own attorney at trial a decade ago and maintains he was wrongfully convicted could soon be released from prison.

The Detroit Free Press reports Omar Pouncy has a hearing today in U.S. District Court where a document filed with the court says he'll be released on bond.

Pouncy's attorney David Moffitt says his client will "actually walk out of the federal courthouse free."

Moffitt says Pouncy's conviction on carjacking, armed robbery and weapons charges was overturned. A judge found Pouncy's waiver of counsel was involuntary because he was forced to choose between an unprepared defense attorney and representing himself.

The carjackings were in 2005. Genesee County prosecutor's office spokesman John Potbury says in an email they intend to retry him.
