Panel to discuss certified questions from federal to state court May 13

The State Bar of Michigan's Appellate Practice Section, Federal Bar Association Eastern and Western District of Michigan Chapters, and SBM U.S. Courts Committee will present the webinar "Am I Certifiable? Considerations Regarding Certified Questions from Federal to State Court." The online program will take place Thursday, May 13, from noon to 1:15 p.m. via Zoom.

The discussion will focus on certified questions from a federal court to the state Supreme Court, including the perspectives of the sender (a federal trial court judge and appellate court judge) and the receiver (a Supreme Court justice), as well as a practitioner. The panel will discuss what kinds of questions they have certified and what kinds of questions they have accepted for certification, the factors considered on each end, and when an attorney should file a motion to certify a question.

Speaking on the panel will be:

  • Michigan Supreme Court Justice David F. Viviano.
  • U.S. Court of Appeals Judge Joan L. Larsen, Sixth Circuit.
  • U.S. District Court Judge Thomas L. Ludington, Eastern District of Michigan.
  • Deputy Attorney Solicitor General Ann Sherman, Michigan Department of Attorney General.
