Feds tell judge: Don't modify justice's sentence
ANN ARBOR (AP) -- Federal prosecutors are opposing a request by a former Michigan Supreme Court justice to be released early from prison.
In a court filing Tuesday, the government tells Ann Arbor federal Judge John Corbett O'Meara that it's too late to change Diane Hathaway's sentence for fraud. Prosecutors also say her bank fraud brought "disrepute" to the judiciary.
Hathaway is about six months through a one-year sentence in a West Virginia federal prison. She wants the judge to reduce her sentence or at least put her on home detention.
Hathaway says she's earned 14 certificates in activities such as "sweating to the oldies" and brisk walking.
She pleaded guilty to fraud for shifting properties and failing to disclose assets while trying to dump her Detroit-area home in a short sale.
