Family of man shot 20 times by police loses appeal
REDFORD TOWNSHIP (AP) - Officers at a suburban Detroit police department are immune to a lawsuit by the family of a man who was shot 20 times inside his bedroom closet.
In a 3-0 decision, a federal appeals court upheld the decision of a Detroit federal judge, although one judge says "there was no need" for police to kill Matthew Krause.
Krause was armed inside his Redford Township home and had refused to surrender when officers tried to arrest him in 2008. After many hours, police used a flash grenade to surprise Krause.
Krause was killed after police say he fired his gun. The appeals court last Wednesday said Redford officers are immune to a lawsuit because they didn't violate Krause's constitutional rights.
Nonetheless, Judge Algenon Marbley says there were "safer, simpler" options.
