Judge Pauline Newman, 'titan of patent law,' to speak at 2023 ABA-IPL IP Fall Institute

Judge Pauline Newman, the longest-serving judge of the U.S. Court of Appeals for the Federal Circuit, will deliver keynote remarks during the 2023 IP Fall Institute, sponsored by the American Bar Association Section of  Intellectual Property Law. The two-day institute will be held virtually Oct. 12-13.

Newman, a former research scientist and patent attorney, was the first judge appointed directly to the federal circuit by President Ronald Reagan in 1984. She will speak at 2:30 p.m., Friday, Oct. 13.

The program also will feature expert panels on artificial intelligence, updates on the Unified Patent Court and an exploration of the boundaries of fair use and parody in copyright and trademark law. Panelists will review recent Patent Trial and Appeal Board Program initiatives and provide insight into best practices.
Program highlights include:

• “Redefining the Boundaries of Fair Use and Parody in Copyright and Trademark Law” — Experts will review the Supreme Court’s decisions in Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith and Jack Daniel’s Properties, Inc. v. VIP Products LLC, which address fair use and parody in the context of copyright and trademark law, respectively. Both cases examine the interplay between First Amendment protection for speech and intellectual property protection for copyright and brand owners. The panel will address the practical implications of both decisions for practitioners and businesses.—Thursday, 2-3 p.m.

• “AI & IP: IP Protection for AI-Generated Works, How AI Can Facilitate IP Protection and Regulation of AI Use” — As the capabilities of AI expand, so, too, does its use by businesses and artists. Speakers will discuss their uses of AI; available IP protections for resulting works generated with the use of AI; how AI may be used to facilitate IP protection; and current and proposed AI regulations and policy.—Thursday, 3:30-4:30 p.m.

• “UPC Update” — Practitioners will provide updates on launching the system for obtaining unitary patents. Participants will learn how to navigate technical issues in the Unified Patent Court, where to file an action based on specialized courts and what to do when you receive an action.—Friday, 12:30-2 p.m.
