On Thursday, February 26, Zappa was sentenced by Macomb County Circuit Court Judge Joseph Toia for a single count of First-Degree Child Abuse. Judge Toia sentenced Zappa to 216-360 months (18-30 years) in the Michigan Department of Corrections. Zappa is to have no contact with the victim or the victim’s family. He is also subject to registration under Wyatt’s Law, which is a database of individuals who are convicted of criminal offenses related to children.
Assistant Prosecuting Attorney Colleen Worden prosecuted the case on behalf of The People.
On October 23, 2024, Zappa was babysitting his then-girlfriend’s eight-month-old baby boy while she was at work. Zappa called 911 claiming the baby was not acting like himself. The baby was taken to the hospital and was listed in critical condition. The jury convicted Zappa after being presented with compelling evidence that Zappa caused devastating injuries to the child, including an acute subdural hematoma (a severe brain bleed), more than 100 retinal hemorrhages in both eyes, extensive bruising across the infant's body and blood from the mouth. Evidence included testimony from multiple treating physicians who detailed the severity of the injuries and the impact on the child.
“I want to recognize the tireless efforts of law enforcement, the medical professionals who provided lifesaving care and testimony, and the jury for ensuring accountability in this case. My office exists to protect the innocent and to speak for children who cannot speak for themselves. We will relentlessly pursue justice against those who abuse and endanger our most vulnerable members of the community,” said Macomb County Prosecutor Peter J. Lucido.
