The Michigan Court of Appeals recently affirmed a lower court ruling, which will allow the BlueOval Battey Park project in Marshall to continue construction efforts amid questions of zoning.
The legal question came from opponents of the mega site, claiming there needed to be a referendum on a ballot to consider the rezoning of the battery park land.
The court, previously in June 2024, agreed with a Calhoun County judge that the city of Marshall handled rezoning of the land legally and complied with charter rules without a public vote required, dismissing the lawsuit.
The Michigan Supreme Court then vacated the court’s decision based on a 2017 ruling on land transfer, instructing the court to reevaluate, in which the court decided with the Calhoun County judge again to put the production back on track to end this year.
Last week, the court, taking up the issue on remand in Committee for Marshall v. Marshall (COA Docket No. 369603), affirmed the lower court again.
Jim Durian, CEO of the Marshall Area Economic Development Alliance, applauded the decision which he says will boost foot traffic and investment in community that historically suffered job losses and population decline in the last 30 years.
“Our elected officials and local leaders in Marshall have always been committed to following the letter of the law to set up a site for Ford’s project, which will create 1,700 new jobs here,”
Durian said in a statement. “Our community is already experiencing the positive impact of BlueOval Battery Park with more than 2,000 construction workers on site over the past few years
and more than 100 full-time employees who have already been hired by Ford.”
Marshall Mayor Scott Wolfersberger said because of the battery park, the future of Marshall simply looks better.
“Ford’s BlueOval project has been a huge boost for our community and the entire region,” Wolfersberger said in a statement. “Marshall has new hotels that are being built and new businesses that are opening. Our downtown is seeing investment and revitalization at levels not seen in decades.”
