The Prosecuting Attorneys Association of Michigan will present the Traffic Safety Training Program Webinar “People v. Bowden—Setting the Record Straight” on Thursday, November 19, from noon to 1 p.m. via Zoom.
For years, Michigan’s DRE Program waited for the state’s higher courts to address the scientific reliability of the program. When that decision finally came down in November 2022, it was not the ruling supporters had hoped for. But Michigan wants to set the record straight that Bowden should not stop DRE-trained officers from conducting DRE evaluations nor should it stop prosecutors from moving forward with critical DRE testimony in drugged driving cases.
This session will cover exactly what Bowden held and how DRE testimony can be used effectively in court despite the 2022 ruling. This webinar is for both prosecutors and law enforcement officers who need to work together on drugged driving cases. Prosecutors will walk away with a better understanding of what exactly the higher court held in People v. Bowden, allowing them to more effectively rebut defense arguments to use Bowden incorrectly to withhold critical DRE and SFST evidence in drugged driving cases. Officers will have a better understanding of what is expected of them on the stand when testifying in a drugged driving case as a DRE or even ARIDE-trained officer, including how to establish one’s expertise as an expert under Daubert.
The program will by presented by Deputy Adam Schaller, Ottawa County Sheriff’s Office; and Kinga Canike and Eric Wanink, Michigan Traffic Safety Resource Prosecutors.
