Nessel's settlement with Plymouth gas station results in reimbursement opportunity

A BP gas station owner in Plymouth Township previously told to cease and desist from price gouging has agreed to pay a $2,000 fine, Michigan Attorney General Dana Nessel announced Thursday.

Last month, the Department contacted the BP gas station at 39600 Ann Arbor Rd in Plymouth Township after WXYZ, a Detroit-area TV station, spoke to consumers with complaints related to the price of gas. The gas station is owned by PGH Associates, LLC.

At the time of WXYZ’s story, the gas station reportedly listed regular unleaded gas for $3.899 per gallon and premium gas for $4.899 per gallon. Those prices were nearly $1 higher than other area stations.

Wednesday, the gas station owner agreed to pay the State of Michigan $2,000, $1,700 of which will be available as reimbursements to customers who can prove they purchased gas there on May 18. The remaining $300 will be retained by the department for costs associated with the investigation.

“I am encouraged by this outcome, which offers an opportunity for consumers to be made whole,” Nessel said. “Our consumer protection team will continue to seek action against entities that take advantage of customers.”

The agreement, filed with Ingham County Circuit Court, can be read online.

The gas station must pay the fine no later than July 1.

In order to be considered for a reimbursement, a consumer needs to file a complaint either online through the Department’s form or by calling 877-765-8388.
