Council hopes to resolve lien issue by end of year

With two of the three lien issues the Climax Village Council has spent a significant amount of time on cleared up, the Climax Village Council hopes to have a dispute at the third property resolved by the end of the year.

There was $25,000-$30,000 in fees and attorney expense at the three locations the village was attempting to recoup.

The lien at 110 South Main Street is for what was stated at a previous council meeting is a $25 per day fine for permit non-compliance through a court order that totals $10,675. It has been noted at previous council meetings the Council has also absorbed approximately $2,000 in attorney fees during the process at the location.

Village Council President Bill Lewis said the village attorney  continues to review the information provided by the village and from the court order. He had hoped there would be some answers by the end of November, however now he said the attorney hopes there will be a resolution by the end of the year.

It was noted at a previous council meeting there is a new owner at 329 West Maple Street where the Village had a lien against the property. Lewis said a check payment for the lien at 329 West Maple Street has been cleared at the bank. The check clearance notification has been sent to the attorney to remove the lien from the property.

The Council was attempting to recoup $14,920 for demolition and attorney costs at the location.

Lewis said since he signed a warrant, the process to place past due money owed the Village at 115 Watson Street onto the property taxes, will move forward.

A lien at 115 Watson Street has been in place for nearly four years for $2,580 for costs associated with hiring a company to remove items from the yard for an ordinance violation. 

2% Holiday Bonus For 5 Village Employees Approved 


The Council approved a 2% holiday bonus for the five village employees - 3 DPW employees, treasurer and clerk - by a 6-1 vote (Carolyn Kelly voted no).

The 2% bonus is a stipend separate from payroll.

Planning Commission Meets


Finance/Insurance/Administration Chairperson Denise Pyle said the Planning Commission held a meeting December 1.

Since this is the first year the Village has had a planning commission, Pyle said a large portion of the meeting was education based. The planning  commission is currently reviewing the village plat map learning what areas are protected under P.A. 116.

She said the current village plat map is outdated, noting  there are discrepancies of property that show some areas of property that are not claimed by any entity. 

She said the Planning Commission plans to meet again December 15.

DPW Report


Department of Public Works employee Lucas Piper said the leaf vacuum was damaged near the end of the leaf pickup season.

Piper said a piece of 2x4 lumber was in a pile of leaves, causing significant damage when the leaf vacuum attempted to pull the piece of wood through.

Piper said the leaf vacuum will be evaluated for repairs as time permits now that leaf pickup has been completed for the year and the DPW crew had to immediately switch equipment over to snow removal following a heavy snow fall.

Piper said water samples and pumpage reports have been completed for December.

The Christmas tree lights were placed on the tree in the Village Park in time for the Christmas in Climax event December 6.
