Michigan Court of Appeals Judge Christopher Yates said Thursday he will leave the court “in a couple of months,” opening up a vacancy in the 3rd District for Gov. Gretchen Whitmer to fill.

Whitmer appointed Yates to the bench in 2022, and then he won a six-year term in 2024. If he leaves bench in May, that means Whitmer’s appointee will serve at least until Jan. 1, 2029. That appointee would then run in 2028 to fill the remaining two years of Yates’ term.

By waiting to resign until after March 15, Yates ensures that Whitmer’s appointee won’t have to run this November to fill the remainder of his term.

Yates has proven one of the court’s best writers during his time on the bench.

Yates, in a post on X, said he would leave with gratitude for the opportunity and great memories.

“I’m so grateful for the experience of being a judge on two courts, but it’s about time for me to let someone else have the privilege of serving,” he said.
