It is alleged that on May 28, Fooks entered the victim’s vehicle through the passenger door while the victim was pumping gas at a station near Market Street and northbound Gratiot Avenue.
When the victim entered the vehicle and ordered Fooks to get out, Fooks allegedly pointed a knife at him while rummaging through the vehicle.
Fooks then allegedly took a bottle of Febreze and walked away. When responding law enforcement officers ordered Fooks to stop, he allegedly fled on foot before officers detained him.
Last Thursday, Fooks’ preliminary exam was held before Judge Sebastian Lucido of the 41-B District Court in Clinton Township and the judge bound Fooks over on the following charges:
Robbery – Armed, punishable by any term of years up to life
Assault with a Dangerous Weapon (Felonious Assault), a 4-year felony
Police Officer – Assault/Resist/Obstruct, a 2-year felony.
Fooks also has a Habitual Offender – Second Offense Notice, an aggravating sentencing factor.
Fooks will be arraigned before Judge Michael Servitto of the Macomb County Circuit Court on October 26.
