Michigan Attorney General Dana Nessel recently filed a lawsuit against Triple Circle LLC, Double Circle LLC, Goodrich Enterprise LLC, and Brad Scott for allegedly violating the Michigan Consumer Protection Act. It is alleged that the defendants, which were associated with two generator franchises owned and operated by Scott, accepted deposits for generators from Michigan consumers across multiple counties, failed to provide refunds of deposits to consumers after the franchises closed, and failed to refund consumers who cancelled their orders for generators. The lawsuit, filed in the 17th Circuit Court in Kent County on September 8th and served on defendants last week, further alleges that Scott used the franchises’ business revenue, including from Michigan consumers’ deposits on generators, for personal purchases.
In December 2020, Scott and Goodrich Enterprise entered into franchise agreements with Generator Supercenter Franchising LLC to operate two Generator Supercenter franchises and sell home generators to Michigan consumers: Generator Supercenter of Grand Rapids and Generator Supercenter of Detroit, located in New Hudson.
By early 2023, it is alleged that the franchises were struggling financially. The lawsuit contends that despite knowing that closure of the franchises was imminent, the stores continued accepting thousands of dollars in deposits for generators from Michigan consumers. Generator Supercenter Franchising terminated the franchise agreements with Scott in April 2024.
Following the closures, numerous residents who had paid deposits on generators had not received their generators or refunds of their deposits.
“Michigan families across the state simply wanted the comfort of knowing they could keep the lights on and their heat or air conditioning running in the event of a power outage,” said Nessel. “Instead, they were caught up in deceptive business practices that left them out of thousands of dollars. My office will continue to investigate and pursue bad actors who siphon off the hard-earned money of Michigan consumers while failing to deliver their purchased items.”
The attorney general is seeking monetary damages and restitution for impacted customers, injunctive relief, and civil fines.
